The privacy is as much important to the organization or any other victim. In many cases it may be required for the computer forensics to share the data or compromise with the privacy to get the truth. But it is also possible the victim organization might lose out the trust over computer forensics team. The trust of the client is an important property that is needs to be addressed. More over there are organizations where in any slight leakage of the issue may attract huge media attention. It is also possible that due to this reason the reputation and finally the business of organization are endangered. There are many issues relating to investigation process. In the event of proper investigation of civil cases the privacy of the client may need to be compromised. It is all dependent over the sensitivity of the issue and the requirement of the result. The code of ethics also requires the computer forensics professional to maintain the privacy of the client. There are certain rules and guidelines that need be followed in order to maintain the ethicality of the issues. These rules also address the privacy concern and its issues. These guidelines are provided by the EC council. The first thing is to maintain the confidential information as private as possible. It should not be used to extract any benefit. Do not use the personal information such as the name, email, SSN – Social Security Number, phone numbers etc. It is not advisable to release any such information that is related to the client. The consent of the client should be sought in order to deal with the issues. The entire situation and the consequences should be related to the client before any taking any decision that can affect the privacy of the client. Do not release any information that may help the rivals to take advantage of the issue. Protection of intellectual property rights is also a major concern in relation with privacy. Disclosure of any information of the client to the Internet community, the public, by direct or indirect means is a violation of policies code of conduct. Any type of electronic transaction leads to disclosure of assets is also violation of code of ethics. Before the process of investigation starts it is advisable for the computer forensics team to provide information about their service, areas of competence, any limitations regarding experience and education. It may also be possible that the computer forensics professional may not share the information with any third party but takes the advantage of the confidential information of the client himself. Suppose the case of data recovery of text files containing credit card information. The data recovery expert may take the advantage and gain the monetary benefits. This is a clear violation of the policy and must attract the attention of the law. A proper case of violation of right to privacy should be initiated against such a professional. |
