When ever the computer forensics expert checks or starts the investigation it is required to get a formal written copy of the authorization to start the investigation. It is required in some cases that the computer forensics professional should make note or get the permission to use some specific tools for the investigation. And after the proper approval can only use them. The computer forensics is a relatively new subject in the field of legal processes hence the existing laws and legal policies are not sufficient to deal with the nature of the crime. There still exists confusion regarding the usage of some laws. It is difficult in some cases to predict and pronounce the judgment. Most of the countries have evolved the law to support the computer forensics. There are many improvements being made in the computer forensics field that can offer the some relief for the computer forensics professional. Laws are being made stringent to deal with the computer criminals. Since the introduction of the computers has made the life easier for most of the people, but at the same time the same ease is can be used for committing the crime. The ease of crime has increased with the usage of computers. Imagine a computer criminal just sitting over a computer with internet access and transferring the money from a bank in an illegal way. The most important aspect of the legalization of the computer forensics is to introduce the computer evidence in the court of law that is admissible to the standards of the court. There exist three laws that are used effectively to curb the computer related crimes. Also there are many more laws that are being framed to catch and punish the computer criminals. They are Wiretap Act, Pen Registers and Trap and Trace Devices Statute and the last but not least is the Stored Wired and Electronic Communication Act. Violation of any of these laws attracts the prosecution of the court of law. |
